The National Court lifted this Thursday the prohibition to transfer to the Port of Ceuta part of the immigrants who entered Ceuta in the massive entry at the end of July and who remain in the autonomous city.
The Contentious-Administrative Chamber agreed on Wednesday to suspend that transfer until studying the request of the Unified Police Union (SUP) to urgently block the central Government’s plans to thus alleviate coexistence problems in the city.
The Eighth Section has already studied the resolution of the Ministry of Transport and finds no reason to adopt the urgent precautionary measure for the reasons of “protection, emergencies and occupational risk prevention” alleged by the police union.
The challenged resolution “states in this regard that reasons of general interest are appreciated that justify granting the requested authorization, “without prejudice to the adoption of the necessary measures to guarantee its compatibility with the security, protection and normal operation of the port,” the court emphasizes. And it adds that it is expressly established that Transport will request “from the Ministry of the Interior its active collaboration and provision of necessary means to reinforce security”.
“Thus,” says the Chamber, “it will be the provisions adopted by the Ministry of the Interior that determine those security conditions for the agents who serve in the facilities and for the migrants themselves and other personnel assigned there”.
The result is that it does not consider it necessary to immediately agree to the suspension, although the study of the precautionary measure will continue after requesting a report from the affected parties.
