The Supreme Court has again denied freedom to Koldo García, former advisor to former minister José Luis Ábalos, in a ruling where it states that its first sentence on the corruption plot that nested in Pedro Sánchez’s Government will be known “immediately”.

Furthermore, in the same ruling, the Chamber describes the facts tried in the mask case as “very serious”. The court also responds to Koldo García that he cannot remain free as businessman Víctor de Aldama is, because each of the defendants has had a “different procedural behavior that implies different treatment and that this Chamber has taken into account”. In this way, the Supreme Court refers to the collaboration that the commissioner has maintained with justice since this corruption case broke out.

In the resolution, the magistrates respond to the former advisor’s defense that “the circumstances valued at the time to agree to the deprivation of liberty persist, which means reproducing the resolutions that have been issued in the case, both by the investigating judge and by the Appeals Chamber, in reference to the risk of flight, derived from the seriousness of the facts tried, the proximity of the trial, and now, due to the immediate final sentence on the facts subject to the imputation, very serious facts”.

The Anti-Corruption Prosecutor’s Office has requested 24 years in prison for the former Minister of Transport and former PSOE Organization Secretary José Luis Ábalos, 19 and a half years in prison for his former advisor Koldo García, and seven years in prison for Aldama.

Both the former right-hand man of President Sánchez and the defendant Koldo García face charges of criminal organization, bribery, influence peddling, use of privileged information, and embezzlement of public funds.

Along with the ‘windfall’ obtained by the plot with the purchase of masks during the pandemic, the High Court has judged the hiring of Ábalos’s former mistress, Jésica Rodríguez, in the public companies Ineco and Tragsa, the rental of the apartment he had in Plaza de España in Madrid, or the favoritism shown to the former minister’s other friend, Claudia Montes, in the company Logirail. Among the facts judged are also the rental operation of the Alcaidesa chalet (La Línea de la Concepción, in Cádiz), Ábalos’s stay in a holiday chalet in Marbella, his role in the rescue of the company Air Europa, the negotiations for the hydrocarbon plot, or the rental contract for an apartment with an option to buy on Paseo de la Castellana in Madrid.
