The Madrid City Council has received a letter from the Government Delegation in which it has communicated that they prohibit the gathering planned for tomorrow Wednesday in Cibeles in support of Ceuta, and which both the opposition leader, Alberto Núñez Feijóo, and the president of Vox, Santiago Abascal, were going to attend. Specifically, these are some of the gatherings in defense of Ceuta that the Spanish Federation of Municipalities and Provinces (FEMP) has called in town halls across the country following the massive entry of more than 70,000 migrants at the end of July and coinciding with the commemoration of Ceuta Day.
“The fundamental rights recognized in the Constitution generally have as holders natural persons, derivatively legal persons created by them, but only very limitedly the Public Administrations. In general, neither mayors as presidents of the respective City Council, nor the City Council itself can be holders of the right of assembly,” states the letter sent to the Madrid City Council from the Government Delegation.
Sources from the Government Delegation have clarified that the event has not been prohibited nor prevented from taking place. It has only clarified that when it is convened by a City Council, it must be considered an institutional act and not a demonstration exercised under the fundamental right of assembly. “The published information confuses a legal clarification about the nature of the call with a non-existent prohibition and that it has been disavowed, since a City Council cannot request the holding of any type of demonstration,” add the Madrid Government Delegation.
The information disseminated by the Madrid City Council and published by some media this afternoon does not correspond to the content of the letter sent to various town halls in the Community of Madrid. The Government Delegation has not prohibited the holding of the events called in support of Ceuta, which may proceed normally if they have been organized by a City Council or communicated to this Delegation by an individual.

According to the Government Delegation, in “Spain, demonstrations are not subject to prior authorization. Article 21 of the Spanish Constitution and Organic Law 9/1983 establish a prior communication regime. Therefore, it is incorrect to state that the Delegation ‘does not authorize’ the demonstration.” “If the gathering were promoted by a natural person, an association, a political party, or any other legitimate legal person, it could be communicated to the Government Delegation in accordance with the Organic Law regulating the right of assembly, as has happened in this case in about thirty municipalities,” add sources from the Delegation.
Furthermore, the Government Delegation assures that it has forwarded the call to the State Security Forces and Corps so that they can adopt the necessary measures to guarantee the security of its holding.
In the case of Madrid, it was called for 8:00 p.m. in the Plaza de Cibeles and the mayor of the capital, José Luis Martínez-Almeida, the national leaders of PP and Vox, as well as the secretary general of the PP of Madrid, Alfonso Serrano, along with other members of the regional party leadership, were also expected to attend.
