The Contentious-Administrative Chamber of the National Court has agreed this Wednesday to suspend the transfer of immigrants to the Port of Ceuta, a measure that the central Government had planned to address imminently. The decision responds to the request of the Unified Police Union (SUP) for the Court to halt the measure as a precautionary measure, that is, without even requesting reports from the affected parties about the suspension.
The SUP warned the court in its filing that there was no record anywhere of the publication of the administrative resolution from the Ministry of Transport allowing the use of around 16,000 square meters of the Poniente expansion of the Port of Ceuta “for the installation of a temporary reception device for migrants, with an approximate capacity of one thousand people”.
Minutes before 11 a.m., the three judges of the Eighth Section resolved to request that the Ministry provide that resolution and the entire accompanying file. And to suspend the transfer until the documentation can be examined and a decision made on the suspension requested by the SUP.

“Prior to resolving the urgent precautionary measure [it is agreed], to require the Ministry of Transport and Sustainable Mobility to urgently, before 12 noon today, send the aforementioned resolution or order to the Chamber electronically, as well as the rest of the documentation contained in the administrative file processed for this purpose. Informing the Ministry that, until this urgent precautionary measure is resolved, the referred resolution or order cannot be executed.”
On September 5, the Government agreed to take control of the port to locate more than a thousand immigrants there, following the resistance of the Autonomous City Government to this measure. Some tents with bunk beds and the necessary services were already prepared to receive part of the migrants who remain installed on the beach.
